My husband and I are filing joint bankruptcy pro se (self filing). He has a old truck we own free and clear. I have a car that is worth about 4000 that I owe $300 that is past due on. I know we are only allowed $1250 for a vehicle. Is that each or total? What is the law or exemption that will let me keep my car? Any ideas or suggestions? Does anyone know where you can find bankruptcy laws like that without a lawyer? Thanks!!
I know about reaffirming but I only owe $300 and that is past due. Can I still reaffirm on that?

Question about repairing credit and joint secured cards?

Laura asked:

My husband and I are trying to build both of our credit scores over the next 12-18 months so that we can qualify for a decent interest rate when we purchase a home. We are looking to put about $1400 (possibly more) on a couple secured credit cards. I’ve heard that the quickest way to build your score is by having a variety of good accounts. He has a car payment on his score as well as a furniture payment. I have a school loan payment. We were thinking of getting 3 cards each with two having $200 on them and the 3rd having $300 and then only spending 10% on each a month and paying them on time.. possibly even adding to the limit now and then (basically a form of savings that looks good on our credit.

However, I am wondering if we even need to have 6 cards between us.. Or could we just have 3 Joint cards? 2 having $400 each and the 3rd having $600?

If you have a suggestion for a secured card to go with that reports to all 3 credit agencies please send me in the right direction. It would be great if they offered joint cards as well.

Right now we are looking at a CitiBank, a Wellsfargo and an Orchard Bank Card (HSBC -which is who our car payment is through)

Any advice would be great. Right now our credit scores are hovering right around 570 and I’ve been paying off old debt and charge offs and such for just over a year and my husband’s score went up for a while and then surprisingly went down.. mine is slightly hire than his and I have less accounts in good standing. I sort of feel like we’re stuck in a rut. Aside from the $13K we still owe on our car we have no debt left to repair so our only option seams to be getting a couple Secured Credit Cards and building credit that way.

Advice is appreciated!

I am applying for a home loan and want the very best interest rate I can get. I have $5,000 in credit card debt. I know that they (the mortgage broker) count the monthly minimum payment for each one plus what the home loan payment would be to come up with my debt to income ratio. I want to get a loan to pay off my credit card debt, the loan payment would be about the same as what the min payment would be of all the cards combined, so no the payments wouldn’t go down, but the interest would be less, but would it benefit me when I get the mortgage? Would they like to see one loan or all the credit card bills seperately? I am looking for whatever would be best, I want to raise my score a little as fast as possible to get a better interest rate.

Loan on Car and selling it to someone for what we owe?

[Marine Wife] asked:

We have a loan on a car and we owe about $10,000. We would like to get rid of the car and get something newer with a warranty. After we bought the car we found out there was more wrong with it, than the carfax report and the seller told us. We would like to get rid of it and we know it’s not worth a whole lot. By the time we sell it in a couple months we will have a little more money saved up and could put about $3,000 on the loan. That would bring the car loan down to $7,000 and we know someone would definately buy it for that because we posted it on craigslist and people are willing to pay roughly or a little over $8,000. What I’m wondering is….say we find a buyer that meets the amount owed on the loan. Could we sell the car and pay the loan off? Also, we do have the title in hand.

I know we will take a big dive on the car, but we are just wanting to get rid of it.
It’s leal to sell it though?
We still have the title because we need to get a new steering wheel air bag. We really dont have a use for it because it’s not turned on and we are looking for and pricing air bags now. Once the air bag gets put in, it goes to the bank.

Do all cars with Carloans have a lienholder? Is the owner (person who took out the loan) the first lienholder?

I ask because I need a replacement title and their is a section for “lienholder information”. I know I have a car loan and the bank holds a lien on my car, in case I do not pay my loan. Do I fill out the banks information as “lienholder information”?

Then below their is a statement “If lienholder does not authorize the department to send title to the owner, the title will be mailed to the first lienholder”

But who is first? Me the loan paying car owner or the bank I have the loan from?
The reason I need a copy of the title is because I moved from FL to NY and to get the NY plates for my car they require to see the title.

When I looked through my records I can not find the title. Only the Cars Invoice, Recipt of Application for title & notice stating my title will arrive within 60 days. But no title.

Due to financial issues I filed for bankruptcy last summer. Can I sue the lawyer who messed up my chapter 7?

I filed a Chapter 7 bankruptcy that should have been completed in July or August at the very latest. My lawyer claimed to have not received my certificate of completion for the post bankruptcy course and let it go. My case was discharged before he told me anything was wrong. I’d called a few weeks before and was told everything was fine ad I’d receive confirmation soon. I was able to prove that he received the certificate and he paid the fee to reinstate my case. I planned when to file so that a year later I could co-sign on a home loan with my husband when he got back from Iraq. Now it’s just been filed and my 1 year mark will be 5 months later so my husband will come home from Iraq and we won’t be able to buy a house. This was hard enough and now he’s made it even worse. We’d have to come up with 15% down at least to get a loan. Can I sue my lawyer for his incompetence and this inconvenience. I’m not looking for free $, I’m just really frustrated and heart broken! Thanks 4 answering!
You don’t know my whole situation and you don’t have to be a jerk. I wasn’t scamming anyone, I stopped working when my daughter died and we couldn’t affort one income at the time. It’s better to pay on a house than to waste money renting so we weren’t planning a scam we were planning to recover from this nightmare!
I can prove he got the certificate because the company I took the course through has the email and fax conformation. I have already spoken to several lenders and they all say 1 year.

If We Were To File, How Soon Would You Be Able To Buy A Home?

My husband and I are taking part in CREDIT SOLUTIONS. We have finally figured after two years, they’re a load of crap. Everything they do, we could have done for free. We have paid these guys thousands of dollars and they don’t even return phone calls.

Anyways, let’s get personal.

My husband makes about 56,000 a year - we have 34,000 in debt. No including our home. Just loans and junk.

I’m wondering about bankruptcy, we’re not making any headway in paying things off. We pay 500 just in health insurance a month! You know?! Child support, ect. We’re broke a lot. :)

If we were to file bankruptcy, how many years would it be before we could buy a home with a backyard? I heard that you can do it sooner than before now.

Any advice or tips???

what happens when the insurance limits aren’t enough to pay my bodily injury claim?

I was a passenger in an auto accident in June where my arm was broken. What happens if the at fault person’s insurance and the underinsured limits from the car I was in is still not enough to pay my claim? Does it then become a personal lawsuit? I think it will come to that because my doc says this injury is one that may not heal. I’m praying it does, but if it doesn’t he’s going to have to do surgery again. That wouldn’t be until next year and I would have to go through all that pain of healing all over again.
